1. Who we are and what is FoxField?

​

FoxField is an online platform for professional service exchanges between entrepreneurs, freelancers and organisations. The platform is managed by Captains and Rebels VZW, a Belgian non-profit association (Isabellastraat 59, 1703 Schepdaal, VAT BE1011.446.516).

FoxField acts exclusively as a facilitating party. We connect members but are not a party to the exchange agreements that members conclude between themselves. All responsibility for the execution, quality and invoicing of trades lies solely with the members involved.

 

2. Access to the platform - Admission policy

Participation in FoxField is reserved for professional entities: self-employed individuals, companies, non-profits and other organisations with a valid business registration number or equivalent professional status.

FoxField expressly reserves the right to:

​

• Deny access to persons or organisations which FoxField, based on its own assessment, considers not to be acting in the spirit of the platform, regardless of whether this is based on prior conduct, professional reputation or other relevant information.

• Terminate an active membership if a member commits violations as described in article 5.

​

FoxField does not discriminate on the basis of protected characteristics as defined in Belgian anti-discrimination legislation. The admission policy is based solely on professional conduct and compatibility with the platform's values.

 

3. Membership and payment

​

A FoxField membership costs €150 per year (ex VAT). This fee grants full access to all Fields and platform functionalities for a period of 12 months. The membership fee is non-refundable, except as provided in article 4. By making payment, the member explicitly accepts this condition. Payment is processed via the Wix platform. Memberships automatically renew unless the member explicitly deactivates this. Revenue from membership fees is used to fund the social and cultural activities of Captains and Rebels VZW.

 

4. Refund policy

FoxField maintains a strict refund policy. The following rules apply:

​

• Refusal prior to activation: if FoxField decides to reject an application after payment has already been made, the full amount will be refunded.

• Termination due to violations (see article 5): no refund. In the event of serious or repeated violations of the terms of use, membership will be terminated immediately without entitlement to a refund of the remaining subscription fee.

• Voluntary cancellation by the member: no refund. Membership expires on the end date of the paid period.

No trial periods, trial versions or partial refunds are offered.

 

5. Code of conduct and sanctions

​

Members commit to behaving in a professional, honest and respectful manner on the platform.

The following behaviours are expressly prohibited:

​

• Deception or fraud of other members in the context of trades

• Transgressive behaviour: bullying, harassment, discrimination, threats or inappropriate communication directed at other members or the FoxField team

• Posting false, misleading or spam requests or offers

• Using the platform for illegal activities or activities contrary to public order

• Undermining the trust and reputation of the platform or other members

• Sharing login credentials with third parties

In the event of a violation, the following sanctions apply:

​

• First violation (non-serious): written warning by email

• Second violation (non-serious): second and final warning. The member is explicitly informed that any further violation will result in immediate termination.

• Serious violation (including fraud, harassment, transgressive behaviour, illegal activities): immediate termination of membership without prior warning and without entitlement to a refund.

FoxField reserves the right to determine whether a violation is considered serious. This determination is final.

​

6. Responsibility for trades

​

FoxField is a neutral platform and is in no way a party to the exchange agreements concluded between members.

Members are fully and solely responsible for:

​

• The content, quality and execution of the services they offer or request

• Their mutual agreements, contracts and communications

• Mutual invoicing: each party invoices the other for the value of the service provided

• Compliance with all applicable VAT, accounting and tax obligations

• Fulfilling any legal obligations applicable to their activity

FoxField cannot be held liable for any damage, financial loss, dispute or non-performance arising from a trade between members. Members who have a dispute must resolve it between themselves, if necessary through the competent court.

​

7. Limitation of liability

​

FoxField and Captains and Rebels VZW are not liable for:

​

• Damage resulting from the failure or incorrect performance of a trade by a member

• Indirect damage, consequential damage or loss of profit

• Technical failures, interruptions or errors in the platform

• Acts or omissions of third parties, including Wix

​

FoxField's liability is in all cases limited to the amount of the membership fee paid by the member concerned.

​

8. Intellectual property

​

All content on the FoxField platform (texts, logos, graphic material, structure) is the property of Captains and Rebels VZW and may not be reproduced, distributed or used without written permission. Members retain intellectual property rights over the content they themselves post on the platform, but grant FoxField a non-exclusive licence to display such content on the platform.

9. Changes to the platform and terms

​

FoxField reserves the right to modify the platform, the Fields and these terms of use at any time. For significant changes, members will be informed in advance by email or via a notice on the platform. Continued use of the platform following notification of changes constitutes acceptance of the new terms.

10. Governing law and jurisdiction

​

These terms of use are governed by Belgian law. In the event of disputes, the courts of the judicial district of Brussels shall have jurisdiction, unless mandatory legal provisions provide otherwise.
